Exit 4 Project PILOT Agreement

Motion by Bacon, second by Starr, to adopt the following resolution:

By Resolution duly passed by the Dansville Central School District we hereby formally request the Livingston County Industrial Development Agency

To become involved in the Exit 4 retail development project sponsored by OpCo (Bella Vista Development Corp) in using Tax Increment Financing, through the mechanism of a Payment-in-lieu-of-Tax to fund publicly owned infrastructure that is necessary to enable the project, anchored by Wal Mart to be constructed and opened.

The Dansville Central School District understands that in making this request to the Industrial Development Agency that:

1.                The implementation of a PILOT by the IDA to undertake this request means that the Dansville Central School District may forgo most of all new tax revenue generated by the project for a period as long as 15 years.

2.                That in making this request the Dansville Central School District understands it is prepared to enter into a PILOT Agreement with the Agency and other taxing entities at a later date that would legally bind the District to the outcome as defined in #1.

3.                That if the LCIDA is legally challenged in this transaction that the Dansville Central School District agrees to assist in the LCIDA’s legal defense costs proportional to its share of the real property tax levy among the County of Livingston, Town of North Dansville and the Dansville Central School District, whether or not the legal challenge supports or disapproves the IDA’s actions.

4.                That this resolution will only be taken up by the Livingston County Industrial Development Agency if it is concurrently enacted upon by all the involved taxing entities, that is the Town of North Dansville, the Dansville Central School District and the County of Livingston
